The Federalist, XLVII
The author intends to investigate THE STRUCTURE AND DISTRIBUTION OF POWERS OF THE FEDERAL GOVERNMENT.
The OPPONENTS OF THE CONSTITUTION reject the alleged abuse of the principle of policy: THE EXECUTIVE, LEGISLATIVE AND JUDICIAL ARE ARRANGED IN SUCH A WAY THAT EVERY BALANCE IS RUINED AND THERE IS A RISK THAT CERTAIN AREAS WILL BE DESTROYED BY THE EXAGERATED POWER OF OTHERS. In the structure of the federal government this measure is ignored, by which the legislature, the executive and the judiciary have to be distinct and different. However, the author maintains that the hoarding of power would be a tyranny and THE CONSTITUTION IS NOT THE CAUSE OF THIS ACCUMULATION OF POWER. Although in many cases the essential principle of the separation of powers was abused, it was thanks to an exaggerated combination of power of the different agencies and no measures were taken to avoid this situation.
