The 26th Edition of the Guide has been revised throughout, including:
Raymond H. Mikkola, a partner at the law firm Pallett Valo LLP has added new content to Chapter 7 (Affidavits, Declarations and Recitals) that discusses whether the sale of a condominium unit constitutes an exempt sale of a residential complex under the Excise Tax Act. Mr. Mikkola has added new content to Chapter 10 (Practical Matters and Vesting Orders) regarding registration of court orders on title, including matters dealing with the wording and content of orders, and has updated the content in Chapter 15 (Notices) that discusses rights of first refusal. Mr. Mikkola has also added a case comment to Chapter 25 (Plans and Surveys) that notes the effect of the failure to bring forward a deregistration of a subdivision bylaw when property is converted from the Registry System to the Land Titles System.
New case annotations have been added to the commentary throughout the Guide, including to the sections that discuss remedies on default, easements, condominiums, power of sale, expropriation, adverse possession, the Ontario New Home Warranties Plan, and Planning Act compliance.
