The purpose of this guide is to alert the reader to the relevant issues, principles, and precedents that have evolved from the basic tenets of the right to counsel as guaranteed by section 10(b) of the Charter. It does not purport to be a substitute for comprehensive and exhaustive research that would need to be carried out as the case law continues to evolve. Instead, it is the starting point: highlighting the issues that counsel need to take into account, laying the foundation for arguments that need to be considered and advanced, and setting the stage for future arguments.
