Estate planning should be individualized to fit a client's need and circumstance. Both the lawyer and client must be willing to accept and embrace change. In fact, the essential task of a lawyer is to assist clients in understanding and in coping with change.
Since this publication was first written and revised in October 2009, major changes have shaped the future of planning. Congress passed The Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act of 2010 and the Michigan legislature passed and implemented Michigan's Trust Code in 2010 and several technical amendments to the Michigan Trust Code in 2011.
In this changing world, it is perilous to present a book containing forms for standard use. The forms in this book, we believe, comply with federal and state law as it exists today.
