The new edition contains three new chapters on trusts, and helpful sample documents and forms for your practice. The first edition of this book was published not long after significant amendments to the New Jersey Probate Code (Title 3B) took effect. The 2005 amendments substantially revised the then existing law governing wills and estates. This new edition explores in detail the case law interpreting the amendments, especially in the area of "writings intended as wills" which expanded the category of documents that could be admitted to probate. In addition, three new chapters titled "Divorce, Annulment and Death," "Litigation Involving Non-Probate Assets," and "Issues Unique to Trust Litigation," have been added to this new edition based on the proliferation of published cases over the past several years in these areas.
