本书主要依据《物权法》、《农村土地承包法》、《森林法》等相关法律法规、司法解释，结合国内外现有相关理论研究成果和福建省集体林权制度改革的政策与实践，运用类型分析方法、规范分析方法、实证分析方法、比较分析方法等多种研究方法，对集体林权的概念、林地物权、林木物权、集体林权流转、集体林权的登记与备案等问题，从法理上做出合理的阐释，从制度上进行科学的构建，以推动我国集体林权制度改革的深入发展和集体林业物权法律制度的完善，促进林农利益的法律保护和集体林业的可持续发展。This book is mainly based on the relevant laws and regulations including Property Law, Rural Land Contract, Forest Law and their corresponding judicial interpretations. It combines the research findings about relevant theories both at home and abroad with the policies and practices of the reform of the collective forest property right system in Fujian Province.
