Having found his patent invalid without determining his claim of patent infringement, courts have precluded the patent owner from participating in his case, in violation of due process. This leaves the alleged infringer (usually large Corporations)free to collect royalties and profits on their patent, alleged invalid by the owner of the invalidated patent, had the court determined his claim of patent infringement.
