Compulsory licences are not a right of use, but a legal right to grant access to an intellectual property right. If the creditor uses the intellectual property right without permission, the holder of this right can proceed against the infringement. In 2009 the German Federal Supreme Court's decision, known as Orange-Book-Standard, approved the antitrust objection of compulsory licence in patent infringement proceedings. This dissertation concerns with the admissibility of the objection and its constitutionality. It relates to both categories of compulsory licences against the injunctive relief of the intellectual property. The author concludes objections of compulsory licenses are not commensurability and because of this fact illegitimate. An adequate instrument for both parties is the interlocutory injunction.
